By using Nightcap you confirm you are 18 years of age or older. Users under 18 are strictly prohibited from using the service, and access is denied at sign-in. A self-declared or confirmed minor is a serious safety finding that we review and act on, up to and including a ban.

Terms & Rules

Simple, clear, enforced.

You must be 18 or older.

Nightcap is strictly for adults aged 18 and over. No exceptions. If you are under 18, close this page immediately and do not use this service. Accessing Nightcap as a minor violates our Terms of Service and may violate applicable law. We review confirmed underage access, remove access, and report to authorities where required by law.

No explicit content — for anyone, ever.

Nightcap is not an adult platform. Nudity and sexually explicit conduct are prohibited for every user, in every chat, with no exceptions and no setting that disables this rule. There is no mode that unlocks or filters out unfiltered content.

Content is monitored for safety and legal compliance.

Nightcap monitors sessions for illegal and prohibited content, including but not limited to: sexually explicit content, child sexual abuse material (CSAM), credible threats of violence, terrorism-related content, and non-consensual intimate imagery. Nightcap retains the right and obligation to scan for illegal content and to cooperate with law enforcement as required by law.

You're responsible for what you show and say.

By using Nightcap you acknowledge: (a) you are an adult and represent yourself honestly; (b) you are responsible for the content you transmit; (c) you may exit any chat at any time using the "Next" button; (d) your ability to report a user is never removed. All other rules in this agreement apply to every session.

No content involving minors — ever.

Generating, sharing, or requesting sexual content involving anyone under 18 — real or AI-generated — results in severe, escalating enforcement and a mandatory report. This applies in every chat, with no exceptions. We cooperate fully with law enforcement and the NCMEC CyberTipline.

No harassment or hate speech.

Do not harass, threaten, bully, or use slurs against anyone. This includes race, gender, sexuality, religion, national origin, or any other characteristic.

No user-run bots, or solicitation.

No user-operated bots, scripts, or automation tools posing as a real person. (This doesn't refer to Nightcap's own clearly-labeled AI chat companions, which are a disclosed part of the service — see below.) No unsolicited advertising or promotions. No requests for money, gifts, or personal financial information.

No non-consensual recording.

Recording another user's video or audio without their explicit consent is prohibited and may be illegal in your jurisdiction.

No illegal activity.

You may not use Nightcap for any activity that violates applicable local, state, national, or international law. This includes, but is not limited to, distribution of illegal substances, solicitation of illegal services, fraud, extortion, and blackmail.

AI chat companions are part of the service.

While you wait to be matched with a real person, you may be connected to a text-only AI chat companion instead. It's always clearly labeled as AI in the interface, and it will say so if you ask. AI companion chats are never counted as, or shown as, a real person or an online user.

To appeal a ban, email support@nightcap.chat. Bans related to CSAM or underage access are not appealable.

Limitation of Liability

NIGHTCAP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIGHTCAP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

YOU USE NIGHTCAP ENTIRELY AT YOUR OWN RISK. NIGHTCAP DOES NOT ENDORSE, VERIFY, OR ASSUME RESPONSIBILITY FOR ANY USER-GENERATED CONTENT, INCLUDING CONTENT THAT VIOLATES THESE RULES BEFORE IT CAN BE DETECTED OR ACTIONED.

NIGHTCAP PROVIDES AUTOMATED MODERATION TOOLS AND HUMAN REVIEW BUT CANNOT GUARANTEE REAL-TIME MODERATION OF EVERY SESSION. IN NO EVENT SHALL NIGHTCAP'S TOTAL LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO NIGHTCAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Nightcap, its operators, affiliates, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these terms, or your violation of any rights of any third party.

Disclaimer: Nightcap provides a platform for anonymous conversation between adults. It is not an adult platform — explicit content is prohibited for everyone. We do not endorse or assume responsibility for content generated by users. We provide automated moderation and human review but cannot guarantee real-time moderation of every session.

Privacy: We do not store video or audio streams. Session metadata is retained for moderation and legal-compliance purposes only. See our Privacy Policy.

Governing Law: These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Severability: If any provision is held unenforceable, the remaining provisions continue in full force and effect.

Changes: We may update these terms at any time. Continued use after changes constitutes acceptance. Material changes will be announced via a banner on the site.
